Mind Match — Terms of Service

Welcome to Mind-Match (“Mind-Match,” “we,” “our,” or “us”), an educational quiz platform designed for academic enrichment, competitive learning, and exam preparation.

By accessing or using our website, mobile application, or services (collectively, the “Service”), you agree to these Terms of Service (“Terms”).

1. Eligibility & Age Restrictions

• You must be at least 13 years old to create an account.
• Mind-Match is not directed to children under 13.
• We do not knowingly collect personal information from children under 13 in compliance with COPPA.
• Users under 18 must have parental or guardian consent.
• Accounts found to belong to children under 13 will be terminated and associated data deleted.

2. Educational Purpose

Mind-Match is designed to support:

• Academic practice
• Exam preparation (including AP-style content)
• Classroom competitions
• Independent learning

We do not guarantee academic outcomes.

3. School Use & Student Data

When used by a K-12 educational institution under a written Data Privacy Agreement:

• When designated by the school as a "school official" with a legitimate educational interest under FERPA (34 CFR § 99.31(a)(1)(i)(B)), Mind-Match is bound by FERPA's restrictions on the use and re-disclosure of student education records.
• Student data is used solely for educational purposes authorized by the school.
• Student data ownership remains with the school or district.
• We do not sell student personal information.
• We do not use student data for targeted or behavioral advertising.
• We do not create non-educational student profiles.
• Schools may request a Data Privacy Agreement, including SDPC National DPA-style templates and state-specific supplements (e.g., NY Ed Law § 2-d Parents' Bill of Rights), at help@appgeniusstudios.com.

Where required by state student privacy laws (including California, Colorado, Connecticut, Virginia, Utah, Texas, Illinois, and New York student data protection statutes), we comply with applicable restrictions.

4. Accounts & Security

Users agree to:

• Provide accurate information
• Maintain account confidentiality
• Notify us of unauthorized use

We may suspend accounts for violations.

5. Acceptable Use

Users may not:

• Manipulate scoring systems
• Reverse engineer the Service
• Harass other users
• Upload unlawful or harmful content

6. Intellectual Property

All quizzes, software, graphics, branding, and content are the property of Mind-Match and protected by intellectual property laws.

7. Advertising

Mind-Match uses third-party advertising services, including Google AdMob and Google AdSense.

• Ads may be personalized for non-school accounts.
• For school-managed accounts, we restrict use of student data for advertising.
• We do not use student data for behavioral advertising.

Third-party advertisers operate under their own privacy policies.

8. Privacy

Use of the Service is governed by our Privacy Policy.

9. Termination

We may suspend or terminate access for violations of these Terms.

10. Disclaimer of Warranties

The Service is provided “AS IS” and “AS AVAILABLE.”

We disclaim all warranties to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by law, Mind-Match shall not be liable for indirect, incidental, or consequential damages.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

13. Changes

We may update these Terms periodically. Continued use constitutes acceptance.
